The latest in the encounters between The Source owners and Eminem has hit a new high and the courts are set to be the new battleground. Earlier this week New York judge Gerald E. Lynch ruled that Slim Shady’s copyright-infringement against the hip-hop magazine would go to trial. The ongoing war between Ray Benzino and Dave Mays (The Source owners) and Em is over the release of excerpts of two early recordings.
The controversial recordings are of a pre-millionaire Shady offensively commenting about black women. In 1998 the rapper made a rap about a former black girlfriend, one of the freestlyes on The Source CD were, "Never date a black girl, because they only want your money/ And that sh-- ain't funny."
Eminem had an early injunction on the publication stopping them from releasing their mix CD with the raps on, but this was overruled, allowing them to release snippets. MTV insiders have obtained this statement from Dave Mays, "This case is about freedom of the press, freedom of speech and the way that he and Shady [Records] have tried to suppress those freedoms. These guys are trying to use the courts and their finances to stop us from doing what every other press outlet does on a daily basis."
